Terms of Service

Effective October 15, 2026

These terms are an agreement between you and Antonio Martinez (“Sigamos,” “we,” “us”) about your use of the Sigamos app and website. By using Sigamos you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use Sigamos.

1. Who can use Sigamos

You must be at least 13 years old. If you’re under 18 (or the age of majority where you live), you need a parent or guardian’s permission, and they agree to these terms for you. You’re responsible for keeping access to your account (your email, Apple ID, or Google account) secure.

2. Not medical advice

Sigamos is a motivation and tracking tool. It is not a medical device and does not provide medical, health, or fitness advice. Goals, streaks, reminders, and incentives are for encouragement only. Talk to a doctor before starting or changing an exercise program, especially if you have a health condition, and stop exercising if you feel pain, dizziness, or shortness of breath. Workout and health numbers come from Apple Health and your devices and may be inaccurate. You exercise at your own risk.

3. Partners and your content

• When you accept a partner, you choose to share your activity with them as described in the Privacy Policy. Only add people you trust, and you can remove a partner at any time.
• You own what you post: photos, notes, comments, voice messages, and incentive text. You give us a limited license to store, process, and display it only to operate Sigamos (for example, showing your check-in to your partners). This license ends when you delete the content or your account, except for backups kept for a short period.
• Only post content you have the right to share, and don’t post photos of other people without their permission.

4. Incentives

Incentives let partners promise each other real-world rewards (like “coffee on me”). Sigamos only records and tracks these promises. Sigamos is not a party to them, does not handle money, and is not responsible if a reward isn’t delivered. Don’t use incentives for gambling, payment for services, or anything illegal. XP earned from incentives has no cash value.

5. Acceptable use

Please don’t:

• harass, threaten, shame, or bully anyone, or send nudges, comments, or voice messages meant to hurt;
• post content that is illegal, sexually explicit, hateful, or violent, or that infringes someone else’s rights;
• impersonate someone, create accounts for others without permission, or try to access other people’s data;
• interfere with, reverse engineer, or overload Sigamos or its systems, or use it to send spam.

We may remove content or suspend accounts that break these rules.

6. Beta software

Sigamos is currently in beta through Apple TestFlight. Features may change, break, or be removed, and the service may be unavailable at times. We’ll try not to lose your data, but please don’t rely on Sigamos as your only record of your workouts.

7. Third-party services

Sigamos works with Apple Health, Sign in with Apple, Google Sign-In, and Apple’s TestFlight and notification services. Your use of those services is governed by their own terms. Apple is not responsible for Sigamos or these terms.

8. Ending your use

You can stop using Sigamos at any time and ask us to delete your account (see the Privacy Policy). We may suspend or end your access if you break these terms or if we discontinue Sigamos; if we discontinue it, we’ll try to give you notice.

9. Disclaimers

Sigamos is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent allowed by law.

10. Limitation of liability

To the fullest extent allowed by law, Sigamos will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any injury, lost data, or lost profits, arising from your use of Sigamos. Our total liability for any claim relating to Sigamos is limited to the greater of the amount you paid us in the past 12 months or US $50. Some places don’t allow these limits, so they may not apply to you.

11. Governing law

These terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in New Jersey, unless the law where you live requires otherwise.

12. Changes

We may update these terms. If we make significant changes, we’ll let you know in the app or by email before they take effect. Continuing to use Sigamos after that means you accept the updated terms.
